Pension Disclosure Update On July 1, 2012, Department of Labor (“DOL”) regulations became effective stating that covered service providers to ERISA (Employee Retirement Income Security Act) governed retirement plans had to provide written disclosures about their services, fiduciary status, and compensation to the “responsible plan fiduciary” for all their existing plan clients. Failure to do so made their service arrangements prohibited transactions under ERISA.

Pension Plan & Retirement Limits for the Tax Years 2007-2013 On October 18, 2012, the IRS announced the cost of living adjustments (COLA) affecting dollar limitations for pension plans and other retirement related items for Tax Year 2013. Overall, while some will remain unchanged, many of the pension plan limitations will change for 2013 because the increase in the cost-of-living index met the statutory thresholds that trigger their adjustment.
